Private Motion: Negative the Motor Vehicles and Road Traffic (Mobile Devices) Regulations, 2010

House of Representatives - 1st Session - 10th Republican Parliament

WHEREAS on November 26, 2010, the Minister of Works and Transport laid the Motor Vehicles and Road Traffic (Mobile Devices) Regulations, 2010 in the House of Representatives;

WHEREAS there is no specific provision in the Motor Vehicles and Road Traffic Act (the Parent Act) that refers to or governs the regulation of mobile devices;

WHEREAS for the said regulations to be effective a general power to regulate mobile devices should be given to the Minister in the Parent Act;

WHEREAS the non-existence of a specific power to regulate mobile devices in the Parent Act could lead to a legal challenge of the said Regulations;

BE IT RESOLVED that the Motor Vehicles and Road Traffic (Mobile Devices) Regulations, 2010 be negatived.
